The Customer is informed of the regulations concerning marketing communications, the Law of 21 June 2014 on confidence in the digital economy, the Data Protection Act of 6 August 2004 and the General Data Protection Regulation (GDPR: No. 2016-679).

1.1. Parties responsible for collecting personal data

For Personal Data collected in connection with the creation of the User’s personal account and their browsing on the Website, the data controller is: https://blooming-pets.com is represented by Charlotte GUÉRARDELLE, its legal representative.

As the entity responsible for processing the data it collects, https://blooming-pets.com undertakes to comply with the framework of the legal provisions in force. In particular, it is the Customer’s responsibility to establish the purposes of its data processing, to provide its prospects and customers, based on the collection of their consent, with complete information on the processing of their personal data, and to maintain a register of processing operations that reflects reality. Whenever https://blooming-pets.com processes Personal Data, https://blooming-pets.com takes all reasonable measures to ensure the accuracy and relevance of the Personal Data in relation to the purposes for which https://blooming-pets.com processes it.

1.2. Purpose of the data collected

https://blooming-pets.com may process all or part of the data:

• to enable navigation on the Website and the management and traceability of the services ordered by the user: connection and usage data for the Website, invoicing, order history, etc.
• to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for navigation, IP address, password (hashed)
• to improve navigation on the Website: connection and usage data
• to conduct optional satisfaction surveys on https://blooming-pets.com: email address
• to conduct communication campaigns (SMS, email): telephone number, email address
• for pet-sitting services, whether for the pet owner or the pet-sitter: address, information about pets
• for the communication and promotion of Blooming Pets and its services, on all media (website/app, social networks, blog, newsletters, email/SMS, online and offline advertising, press relations, printed media, trade shows/events), in compliance with the applicable legal bases
• for the prevention and management of disputes, the preservation of evidence, responding to legal requests, and more broadly, regulatory compliance.

https://blooming-pets.com does not sell your personal data, which is therefore only used when necessary or for statistical and analytical purposes.

1.3. Right of access, rectification and opposition

In accordance with current European regulations, Users of https://blooming-pets.com have the following rights:

• right of access (Article 15 GDPR) and rectification (Article 16 GDPR), updating and completion of User data right to block or erase personal User data (Article 17 GDPR) when it is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited
• right to withdraw consent at any time (Article 13-2c GDPR)
• right to restrict the processing of User data (Article 18 GDPR)
• right to object to the processing of User data (Article 21 GDPR)
• right to the portability of data provided by Users, when such data is subject to automated processing based on their consent or on a contract (Article 20 GDPR)
• the right to determine the fate of Users’ data after their death and to choose to whom https://blooming-pets.com shall communicate (or not) their data to a third party they have previously designated

As soon as https://blooming-pets.com becomes aware of the death of a User and in the absence of instructions from them, https://blooming-pets.com undertakes to destroy their data, unless its retention is necessary for evidentiary purposes or to meet a legal obligation.

In this case, the User must indicate the Personal Data that they would like https://blooming-pets.com to correct, update or delete, identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on https://blooming-pets.com by law, particularly with regard to the storage or archiving of documents. Finally, Users of https://blooming-pets.com may lodge a complaint with the supervisory authorities, in particular the CNIL (https://www.cnil.fr/fr/plaintes).

Users may object at any time to communication processing based on legitimate interest.

1.4. Non-disclosure of personal data

https://blooming-pets.com undertakes not to process, host or transfer the Information collected on its Customers to a country outside the European Union or recognised as « unsuitable » by the European Commission without first informing the customer. However, https://blooming-pets.com remains free to choose its technical and commercial subcontractors, provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

https://blooming-pets.com undertakes to take all necessary precautions to preserve the security of the Information and, in particular, to ensure that it is not disclosed to unauthorised persons. However, if an incident affecting the integrity or confidentiality of Customer Information is brought to the attention of https://blooming-pets.com, the latter shall inform the Customer as soon as possible and communicate the corrective measures taken. Furthermore, https://www.blooming-pets.com does not collect any « sensitive data ».

The User’s Personal Data may be processed by subsidiaries of https://blooming-pets.com and subcontractors (service providers), exclusively for the purposes of this policy.

Within the limits of their respective responsibilities and for the purposes outlined above, the main persons likely to have access to the data of Users of https://blooming-pets.com are primarily our customer service agents.

Media publications on third-party platforms (e.g. social networks, advertising tools) may involve data transfers outside the European Union. In this case, we use, where necessary, the European Commission’s Standard Contractual Clauses and additional measures. The effective deletion of content published by third parties remains subject to the rules of these services and any reposts by independent accounts.

1.5. Types of data collected

For users of the https://blooming-pets.com website, we collect the following data, which is essential for the operation of the service and will be kept for a maximum period of 24 months after the end of the contractual relationship:

The following may also be collected, where applicable:

• Media: profile photo/video, illustrative photos/videos, reviews/testimonials (text and audio), logos/pseudonyms, and technical metadata (date, device, approximate location if encoded);
• Identification data visible in the Media: image, voice, first name + initial of surname in accordance with the platform’s rules;
• Social media links entered by the User in their profile.

Retention periods: see 1.6.f (publications already made may be retained for archiving and campaign evidence purposes; new promotional uses will cease upon written request).

1.6. User Media (pet sitters and owners) — specific mentions

a) Data concerned
We process the Media that you upload or send to us (see Definitions), including your image, your voice and your first name + initial of your surname as displayed on the platform. Where applicable, recognisable people/places may appear in the Media provided by you.

b) Technical transformations
To ensure compatibility, quality and security, Media may be adapted: cropping, compression, subtitles/transcription, translation, blurring/anonymisation, format variations, in accordance with moral rights.

c) Legal bases (GDPR)
– Performance of the contract: hosting/display of profiles, connection, moderation and security;
– Legitimate interest of Blooming Pets: promotion and communication of its services, security, fraud prevention and preservation of evidence;
– Consent: reuse of content from private messaging in external communications; representation of minors; marketing channels subject to legal opt-in;
– Legal obligation: response to requests/authorities.

You may object at any time to communication processing based on legitimate interest (see GDPR rights).

d) Private messaging
Content exchanged via private messaging is not used in external communications without your explicit consent. It may be processed for security, moderation, dispute prevention/management and compliance purposes.

e) Image, voice and name rights
You authorise the use of your image, voice and name (surname + initial) as they appear in your Media, for the above purposes, without specific financial compensation. The representation of a minor requires the written authorisation of the holder of parental authority.

f) Duration and post-termination effect
– Service: for the lifetime of the account, then limited archiving;
– Communication/marketing: publications already made may be retained (archives, screenshots, campaign evidence, printed materials). Upon written request, Blooming Pets will cease new promotional uses within a reasonable period of time, subject to technical/legal constraints;
– Disputes/compliance: retention until the expiry of the applicable limitation periods.

g) Recipients and publications by third parties
Restricted access to authorised teams and our subcontractors (hosting, e-mailing/CRM, support, moderation, analytics, advertising). In the event of publication on third-party platforms (e.g. social networks, press), deletion and visibility duration depend on the rules of these services and any reposts by third parties.

These provisions are consistent with Article 12.8 of the GTC (Duration – Withdrawal – Post-termination effect).
