These terms and conditions govern the use of the website and services offered by Blooming Pets.
By using our website and subscribing to our services, you fully and unreservedly accept the terms and conditions set out below.
Please read them carefully before using our platform.
For the purposes of these terms and conditions, the following terms are defined as follows:
1. Blooming Pets: refers to the online platform that connects pet sitters with individuals who wish to have their pets looked after.
2. Pet sitter: refers to a natural person who offers pet sitting services via the Blooming Pets platform.
3. Owner: refers to an individual who is looking for someone to look after their pets and uses Blooming Pets’ services to find a pet sitter suited to their needs.
4. Customer: this term refers to the individual who subscribes to a service offered by Blooming Pets.
5. Subscription: refers to the paid membership taken out by pet owners in order to benefit from unlimited access to the features offered by the Blooming Pets platform.
6. Features: encompasses the various tools, services and options available on the Blooming Pets platform, such as pet sitter search, messaging, reviews, etc.
7. Platform: refers to the website and all the features provided by Blooming Pets to facilitate connections between owners and pet sitters.
8. The animal(s): refers to all domestic species listed in the Decree of 11 August 2006 establishing the list of domestic animal species, breeds or varieties.
9. GTC: refers to these general terms and conditions of sale.
Please note that these definitions are provided for information purposes only and are specific to these general terms and conditions of sale of Blooming Pets.
1. Description of services
Blooming Pets offers an online platform that connects individuals looking for pet care with pet sitters. The connection does not include pet sitting, boarding, walking, house sitting or visiting services; these services are provided exclusively by the pet sitter according to the terms agreed between the pet sitter and the pet owner.
Our platform allows individuals to search for, contact and hire pet sitters for their pet-sitting needs.
Three pet-sitting options are currently available.
1. Pet sitting at home
1.1. Home visits
- This service includes regular visits to the owners’ home, the frequency of which will be determined by the owners.
- During these visits, the pet sitter will ensure the animals’ well-being, take care of their basic needs such as food, water and cleanliness, and give them the attention they need.
- The pet sitter may communicate news about the animal or animals to the owner using various means such as Blooming Pets messaging, text messages, emails, etc., in order to keep them informed about the progress of the visits.
- At the owner’s request, the pet sitter may perform light tasks to maintain a healthy environment for the animal, such as airing out the house, watering plants, collecting mail, etc.
1.2. Day care
- Day care includes the pet sitter being present at the owners’ home during the day, according to a schedule predefined by the owners, for a maximum period of 10 consecutive hours.
- During day care, the pet sitter ensures the well-being of the animals by meeting their basic needs: food, water, cleanliness and attention. They also provide playtime and interaction to stimulate and entertain the animals while their owners are away.
- The pet sitter can send regular updates on the animals’ condition and behaviour via Blooming Pets messaging, text message or email, ensuring smooth and reassuring communication with the owner.
- At the owner’s request, the pet sitter can also take care of light domestic tasks to maintain a clean and welcoming environment for the animal, such as airing rooms, watering plants or managing mail delivery.
1.3. Night watch
- Overnight pet sitting involves the pet sitter staying at the owners’ home during the night, according to a schedule set by the owners, usually from 8 p.m. to 8 a.m. This service ensures continuous supervision of the animals, providing security and companionship during the night.
- During night care, the pet sitter ensures the comfort of the animals, responding to their basic needs such as food, water and cleanliness. They are also attentive to their well-being, reassuring and calming them at bedtime, and remain alert to any signs of discomfort or emergency.
- The pet sitter can communicate with the owner through various means, such as Blooming Pets messaging, text messages, or emails, to provide regular reports on how the night is going and the condition of the animals.
- In addition to these duties, at the owner’s request, the pet sitter may perform light tasks such as airing out the house and watering plants, helping to maintain order and security in the home during the night.
1.3. Home-sitting
- Home sitting involves the pet sitter being present at the owners’ home at all times, day and night, according to the terms agreed with the owners. This service provides enhanced security for the home and a stable environment for the animals, and is particularly suitable for extended absences.
- During home sitting, the pet sitter ensures the well-being of the animals by meeting their basic needs: food, water, cleanliness and attention. They also provide opportunities for play and interaction to stimulate and comfort the animals in the absence of the owners.
- The pet sitter can send regular updates on the condition and behaviour of the animals, as well as on the security of the home, via Blooming Pets messaging, text messages or emails, ensuring smooth and reassuring communication with the owner.
- House-sitting also aims to ensure the security of the home and the maintenance of daily routines. As a house sitter, the pet sitter lives in the owners’ home and takes care of routine tasks such as collecting the post, watering the plants, or maintaining the swimming pool if necessary. Their continuous presence helps to deter burglaries and ensures that the home remains tidy.
- The length of stay can vary from a few days to several weeks, depending on the owners’ needs. Although the pet sitter enjoys many benefits in kind, such as accommodation and home amenities, they are responsible for their own food, travel and telephone expenses. At the end of the stay, the pet sitter is expected to leave the house as clean and tidy as it was when they arrived.
2. Dog walking
- This option specifically concerns dog walking.
- Pet sitters will be available to walk owners’ dogs, ensuring they get the necessary exercise and attention for the agreed duration.
3. Boarding kennels for animals
- This option is available to pet sitters who have provided their SIRET number and proof of their ACACED certification.
- It allows pet sitters to take in animals at their home or in a specific building (kennel, cat hotel, etc.) for periods of care. This offers an alternative for owners who prefer their pet to be cared for in an environment other than their own home.
- Pet sitters offering this service undertake to provide a safe, comfortable space that is suited to the needs of the animals in their care, respecting the guidelines and preferences specified by the owner while complying with the regulations in force.
2. Using the platform
2.1. Eligibility
a) To use our platform, you must be of legal age.
b) You agree to comply with our code of conduct and to provide accurate, complete and up-to-date information when registering.
2.2. User responsibilities
a) Individuals are responsible for selecting and hiring pet sitters. Blooming Pets is not responsible for the services provided by pet sitters or for any damage caused to animals, property or persons in connection with these services.
b) Pet sitters acknowledge that they are acting independently and are solely responsible for the pet sitting services they provide.
2.3. Communication with users
a) By creating an account on the blooming-pets.com platform, users agree to receive emails, text messages and calls from Blooming Pets in connection with the use of their account and the use of the platform.
These communications may include, but are not limited to, booking confirmations, appointment reminders, notifications of new messages or activity on their account, special offers, and important information related to their use of Blooming Pets.
b) By accepting these terms and conditions, users acknowledge that Blooming Pets may use the contact information provided when creating the account, such as email address, mobile phone number and landline number, to communicate with them in an appropriate and relevant manner.
c) Blooming Pets undertakes to respect users’ communication preferences and to offer them the possibility to manage their notification settings by following the instructions provided in each communication received.
However, it is important to note that certain messages, such as essential account information, platform usage and security notifications, may be sent regardless of the user’s communication preferences to ensure the proper functioning and security of the platform.
3. Prices and payment
3.1. Subscription fees
a) Pet owners can subscribe to a paid Pass to enjoy unlimited access to the platform’s features.
b) Prices and payment terms are specified when registering for the Pass.
c) Prices are subject to change, but it is important to note that these changes will only apply to future orders. Orders that have already been paid for will not be affected by these price changes.
d) Once the order has been confirmed, the customer will receive an email confirming payment.
e) Please note that certain features of the platform are only available to users with an active subscription. It is necessary to maintain an active subscription in order to continue to benefit from these specific features.
3.2. Remuneration for pet sitters
a) Pet sitting rates are set freely by pet sitters. Blooming Pets does not charge any commission on these rates.
b) Pet sitters have the flexibility to change their rates at any time in the My Profile / My Rates section of their Pet Sitter Account.
c) Payment terms between individuals and pet sitters are agreed directly between the parties, without Blooming Pets having any say in the matter.
4. Pass conditions for pet owners
4.1. Pass names, duration, prices and commitment
Passes for Owners, hereinafter referred to as « Passes », are offered in different packages, each characterised by a specific duration, monthly fee and commitment. The following Passes are available:
Starter
- Commitment: 3 months
Discover
- Commitment: 1 month
Advanced
- Commitment: 6 months
Serenity
- Commitment: 12 months
Flash
- Commitment: 3 days
4.2. Payment for Passes
Payment for Passes is made in a single instalment when subscribing to the chosen Blooming Pets subscription. Once payment has been made, the Owner immediately benefits from the advantages of their subscription for the specified duration.
4.3. Pass renewal
Passes are not subject to automatic renewal. At the end of the commitment period specified for each Pass, it expires without any action required on the part of the Owner. If the Owner wishes to continue using Blooming Pets’ services, they must subscribe to a new Pass by entering into a new commitment under the terms and conditions in force at that time.
5. Privacy and personal data
5.1. Data collection and use
a) By using our platform, you consent to the collection and use of your personal data in accordance with our privacy policy.
b) We are committed to treating your personal data confidentially and securely.
Please note that the use of your personal data is governed by our privacy policy, and it is important to review it to understand how we collect, use, store and protect your personal information.
5.2. Cookies
a) Our website may use cookies to enhance your user experience. You may change your browser settings to refuse cookies if you wish.
6. Intellectual property
6.1 Website content
a) All intellectual property rights relating to the content of the website are the exclusive property of Blooming Pets or its licensors. You are not authorised to reproduce, distribute, modify, transmit, publish, display or exploit in any way the content of the website without our prior written consent.
6.2 Limited licence
a) Blooming Pets grants users a limited, non-exclusive and non-transferable licence to use the website and its content in connection with the use of the services offered.
This licence does not authorise the reproduction, distribution, modification or any other use of the website content that is not expressly authorised.
7. Limitation of Liability
7.1. Disclaimer
a) Blooming Pets undertakes to provide an online platform enabling individuals seeking pet-sitting services to connect with pet-sitters listed on the website.
b) Blooming Pets endeavours to maintain a secure and reliable environment for users of its platform by carrying out reasonable checks on the information provided by pet-sitters when they register on its website.
It is the responsibility of individuals using pet-sitting services to carry out their own checks and make informed decisions.
c) The pet sitter acknowledges that they are solely responsible for their tax obligations regarding the income received for the pet sitting services provided.
d) Under no circumstances can Blooming Pets be held liable or be subject to financial claims if a pet sitter does not comply with the French legislation in force.
8. Insurance
a) Pet sitting is a regulated activity involving the pet sitter’s responsibility. This rule applies to pet sitters who do it occasionally and to pet sitters who do it as their main activity.
b) Pet sitters must take out Professional Civil Liability insurance to cover any damage caused to animals or property belonging to individuals using their pet sitting services.
c) In the event of a dispute, the pet sitter assumes full responsibility for the animal in their care. They may not take legal action against our platform regarding issues related to their civil liability insurance or professional civil liability insurance.
9. Right of withdrawal
9.1 Exclusion of the right of withdrawal
a) In accordance with Articles L.221-18 et seq. of the Consumer Code, the right of withdrawal does not apply to contracts concluded for the provision of accommodation services, transport services, catering services or leisure activities that must be provided on a specific date or during a specific period.
b) Given that the pet-sitting services offered by Blooming Pets fall into the category of leisure services provided on a specific date or during a specific period, the right of withdrawal does not apply.
c) The customer expressly acknowledges and accepts that if Blooming Pets begins to perform the matchmaking service, the customer expressly waives their right of withdrawal.
10. Amendment to the general terms and conditions of sale
a) Blooming Pets reserves the right to amend these terms and conditions at any time. Amendments will be published on our website and will take effect immediately upon publication.
It is your responsibility to review the terms and conditions regularly.
11. Applicable law and competent jurisdiction
a) These general terms and conditions of sale are governed by French law.
b) Any dispute arising from the use of our platform or the services offered shall be subject to the exclusive jurisdiction of the French courts.
12. User Content & Media (pet sitters and owners) — Licence for use & image rights
12.1. Definition
a) « Media » refers to any content provided, published or transmitted via the Blooming Pets platform by a user (pet sitter or owner): texts, reviews, testimonials, photos, videos, audio recordings, logos, pseudonyms, associated metadata, including profile videos and mission visuals.
b) Private messaging content is excluded from external communication uses, unless the user subsequently gives their express consent (see 12.6), without prejudice to its storage/use for service management and dispute resolution purposes (see 12.7).
12.2. Licence granted to Blooming Pets
By posting Media online or transmitting it via the platform, the user grants Blooming Pets a non-exclusive, worldwide, free, transferable and sub-licensable licence allowing it to reproduce, represent, publish, host, reference, adapt and modify said Media (cropping, compression, subtitles, translation, format variations), in accordance with moral rights:
a) « Service » purposes: operation of the platform, improvement, assistance, security, moderation, training of internal teams.
b) Communication purposes: promotion of Blooming Pets and its services on all media and by all means (website and app, social networks, blog, newsletters, e-mail/SMS, online/offline advertising, press relations, printed media, trade shows, sales presentations).
12.3. Right to image, voice and name
a) The user authorises the use of their image, voice and name (first name + initial of surname in accordance with the platform’s rules) as they appear in the Media, for the above purposes, without specific financial compensation.
b) Minors: any representation of a minor requires the prior written authorisation of the holder of parental authority; failing this, the user shall refrain from publishing such Media.
12.4. Testimonials and reviews
a) Blooming Pets may quote, edit for form (spelling, length) and republish reviews and testimonials left on the platform, mentioning the first name and initial of the surname, and, where applicable, the town/city or animal concerned.
12.5. Guarantees and compensation
a) The user guarantees that they hold all necessary rights and authorisations for the Media (including authorisations from recognisable persons, owners of premises/property, rights holders), that the Media is lawful, does not infringe any rights, and does not infringe any third-party rights.
b) The user indemnifies and holds harmless Blooming Pets against any claim, action or conviction resulting from a breach of these terms and conditions.
12.6. Private messaging and specific consents
a) Content exchanged via private messaging is not used in external communications without the user’s express and specific consent (documented opt-in).
b) When required by law (e.g. image rights, personal data), Blooming Pets obtains additional consent before reusing the content for marketing purposes.
12.7. Litigation management, legal compliance
12.8. Duration – Withdrawal – Post-termination effect
a) The licence is granted for the legal duration of the rights.
b) In the event of account closure or withdrawal of a Media, Blooming Pets may retain publications already made (archives, screenshots, campaign evidence). Upon written request, Blooming Pets will cease new promotional uses within a reasonable period of time, subject to technical and legal constraints.
c) The removal by Blooming Pets of content shared with third parties (e.g. social networks) remains subject to the rules of those services.
12.9. Moderation
a) Blooming Pets may refuse, crop, blur or remove any Media that does not comply with these terms and conditions, the law or animal safety/welfare, without compensation, after or without formal notice depending on the urgency.
12.10. Personal information
a) When the use of the Media involves personal data, the legal basis is (i) the performance of the contract for « service » purposes, (ii) legitimate interest or consent for « communication » purposes, as applicable.
b) GDPR rights (access, rectification, erasure, objection, restriction) are exercised in accordance with the terms specified in the .
12.11. Absence of remuneration
a) The online publication of Media and the above authorisation are granted without specific remuneration, with the user acknowledging that they benefit from the visibility offered by the platform.
